Atlas Wellness AZ, LLC (“Atlas Wellness,” “Atlas,” “we,” “us,” or “our”) respects your privacy and is committed to handling personal information responsibly and transparently.

This Privacy Policy explains the types of information we may collect, how we use and protect that information, circumstances in which information may be shared, and the choices available to you regarding your information.

By using our website, communicating with Atlas Wellness, or participating in our services, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

Depending on how you interact with Atlas Wellness and the services you choose, we may collect information including:

Contact and identifying information: Your name, email address, telephone number, date of birth, and other information reasonably necessary to establish and maintain a client relationship.

Fitness and wellness information: Fitness goals, exercise history, current activity level, mobility information, strength or performance assessments, body measurements, progress information, workout records, nutrition information, habits, progress photographs, and other information relevant to providing coaching or training services.

Health and safety information: When reasonably necessary to provide services safely and appropriately, this may include information voluntarily provided through health questionnaires or PAR-Q+ screening, injury or physical limitation information, medications or medical conditions relevant to exercise participation, and other health-related information you choose to provide.

Communications: Information you provide through email, telephone calls, text messages, website forms, coaching platforms, messaging applications, or other communications with Atlas Wellness.

Website and technical information: Information that may be automatically collected when you visit our website, such as browser type, device information, IP address, website activity, cookies, or similar technical information, depending on the technologies and service providers used by our website.

2. How We Use Your Information

Atlas Wellness may use personal information to:

  • Provide personal training, wellness coaching, nutrition education, and related services; 
  • Develop, administer, monitor, and adjust exercise and wellness programs; 
  • Monitor client participation, adherence, and progress; 
  • Communicate regarding appointments, workouts, coaching, scheduling, progress, account matters, or services; 
  • Conduct appropriate health and fitness screening; 
  • Maintain client and business records; 
  • Process and administer memberships and payments; 
  • Provide customer service and respond to questions or requests; 
  • Operate, maintain, secure, and improve our business and website; 
  • Meet applicable legal, regulatory, insurance, accounting, contractual, or business obligations; and 
  • Protect the safety, rights, property, and legitimate interests of Atlas Wellness, our clients, and others. 

We seek to collect and use information that is reasonably related to providing our services and operating our business.

3. Health and Wellness Information

Because Atlas Wellness provides fitness, nutrition education, and wellness coaching services, clients may provide information that is personal, sensitive, or health-related.

Atlas Wellness treats health and wellness information as sensitive information and uses it primarily for purposes related to providing safe, appropriate, and individualized services.

Atlas Wellness is not representing through this Privacy Policy that it is a HIPAA-covered healthcare provider or that information collected by Atlas Wellness constitutes Protected Health Information under HIPAA.

Nevertheless, Atlas Wellness recognizes the sensitive nature of health-related information and intends to handle such information responsibly and with appropriate safeguards.

4. Payment Information

Atlas Wellness does not directly store complete credit-card or debit-card information.

Payment processing, including recurring payments when applicable, is handled through third-party payment-processing services, including Global Payments. Payment processors may collect and maintain payment information according to their own privacy, security, and data-handling practices.

Atlas Wellness may maintain transaction-related information reasonably necessary for legitimate business purposes, such as payment status, transaction records, invoices, receipts, membership information, and amounts paid.

5. Third-Party Service Providers

Atlas Wellness uses third-party services to help operate the business and provide services to clients.

These may include, as applicable:

  • ABC Trainerize for fitness programming, client communication, progress tracking, nutrition or habit tracking, and related coaching functions; 
  • Google services for email, electronic records, documents, scheduling, storage, and related business functions; 
  • Global Payments for payment processing and recurring billing; 
  • GoDaddy and related services for website hosting, functionality, and website-related technologies; 
  • Training facilities or other service providers when reasonably necessary to coordinate or provide services. 

These providers may process information in accordance with their own terms and privacy practices.

Atlas Wellness seeks to limit information provided to third parties to information reasonably necessary for the legitimate purpose for which the third party is being used.

6. How We Share Information

Atlas Wellness does not sell your personal information.

Atlas Wellness does not disclose sensitive health or wellness information to third parties for unrelated advertising or marketing purposes.

Information may be disclosed when reasonably necessary:

  • To service providers assisting Atlas Wellness in operating the business or providing services; 
  • To process payments or administer memberships; 
  • To coordinate services you have requested; 
  • With your direction, authorization, or consent; 
  • To comply with applicable law, regulation, court order, subpoena, or other lawful process; 
  • When reasonably necessary to protect the safety, rights, or property of Atlas Wellness, a client, or another person; or 
  • In connection with legitimate administrative, legal, insurance, accounting, or business needs. 

Where particularly sensitive personal or health information must be disclosed outside the ordinary operation of Atlas Wellness services, Atlas Wellness will seek appropriate authorization when required or reasonably appropriate.

7. Client Privacy, Photographs, and Testimonials

Client information is treated as private by default.

Atlas Wellness does not publicly disclose a client's personal story, photographs, videos, testimonials, health information, progress information, body measurements, before-and-after images, or other identifiable client information merely because that individual is an Atlas Wellness client.

Public use of identifiable client photographs, videos, testimonials, progress information, or similar materials will require separate authorization or an appropriate media/information release.

Participation in Atlas Wellness services does not, by itself, constitute permission for Atlas Wellness to use a client's identity or personal information for promotional or marketing purposes.

8. Communications

Atlas Wellness may communicate with clients through various methods, including email, telephone, text messaging, Trainerize or other applications, and other communication methods agreed upon with the client.

Different communication platforms may provide different privacy and security protections. Atlas Wellness will make reasonable efforts to use appropriate communication methods based on the nature and sensitivity of the information being communicated.

9. Data Security

Atlas Wellness takes reasonable administrative, technical, and organizational measures intended to protect personal information against unauthorized access, disclosure, alteration, loss, or misuse.

These measures may include password protection, access controls, security features provided by third-party platforms, appropriate account-management practices, secure electronic storage, and limiting access to information based on legitimate business need.

However, no electronic storage, communication, or information system can be guaranteed to be completely secure.

10. Data Retention, Correction, and Deletion

Atlas Wellness retains personal information for as long as reasonably necessary to provide services, maintain appropriate business records, fulfill legal, tax, insurance, contractual, or regulatory obligations, resolve disputes, protect legitimate business interests, and meet other lawful business needs.

Retention periods may vary depending on the type of information and the purpose for which it was collected.

When information is no longer reasonably required, Atlas Wellness may delete, destroy, anonymize, or otherwise securely dispose of the information, subject to applicable legal and business record-retention requirements.

Individuals may contact Atlas Wellness to request correction or deletion of certain personal information. Requests will be evaluated subject to applicable law and legitimate record-retention requirements.

11. Cookies, Analytics, and Website Technologies

The Atlas Wellness website and its service providers may use cookies or similar technologies necessary to operate, secure, maintain, and improve the website.

Atlas Wellness may introduce analytics or other website technologies in the future. If our data collection or use practices materially change, this Privacy Policy may be updated accordingly.

Atlas Wellness does not use sensitive health or wellness information provided by clients for third-party targeted advertising.

12. Adults Only

Atlas Wellness services are currently intended for individuals 18 years of age or older.

Atlas Wellness does not knowingly provide its personal training, nutrition coaching, or wellness coaching services to minors or intentionally collect personal information from minors through those services.

13. Third-Party Websites and Services

Our website or communications may contain links to websites, applications, training facilities, or services operated by third parties.

Atlas Wellness does not control the privacy or security practices of independent third parties. Individuals are encouraged to review the privacy policies and terms of those services when appropriate.

14. Data Breaches and Security Incidents

If Atlas Wellness becomes aware of a security incident involving personal information, Atlas Wellness will evaluate the incident and take reasonable steps appropriate to the circumstances.

When notification or other action is required by applicable law, Atlas Wellness will provide required notices to affected individuals, governmental authorities, or other parties as applicable.

Atlas Wellness may update this Privacy Policy periodically to reflect changes in our services, business practices, technologies, service providers, or legal obligations.

The current version will be posted on our website with an updated “Last Updated” date.
