Welcome to Atlas Wellness AZ, LLC (“Atlas Wellness,” “Atlas,” “we,” “us,” or “our”). These Terms & Conditions govern your use of the Atlas Wellness website and your purchase or use of services offered by Atlas Wellness.
By using this website, submitting an inquiry, purchasing services, or participating in Atlas Wellness services, you acknowledge and agree to these Terms & Conditions and any additional agreements applicable to the services you purchase.
1. Services
Atlas Wellness provides wellness-related services that may include personal training, nutrition guidance, recovery and mobility support, wellness and mindset coaching, Atlas Insight Sessions, digital programming, and related educational services.
Specific services, frequency, duration, pricing, and features may vary by offering and will be described at the time of purchase or in the applicable client or membership agreement.
Atlas Wellness may modify, discontinue, or introduce services and offerings as the business evolves.
2. Scope of Services
Atlas Wellness services are educational, supportive, and coaching-based in nature. They are not a substitute for medical care, mental health treatment, physical therapy, medical nutrition therapy, or other services provided by appropriately licensed healthcare professionals.
Atlas Wellness does not diagnose, treat, cure, or prevent medical or mental health conditions.
Clients are responsible for seeking appropriate professional care when needed and for informing Atlas Wellness of injuries, limitations, medical restrictions, or other circumstances that may affect their ability to safely participate in services.
3. Physical Activity and Personal Responsibility
Physical activity involves inherent risks. Participation in personal training, exercise programming, mobility work, or other physical activities offered or recommended through Atlas Wellness is voluntary.
Clients are responsible for working within their abilities, communicating pain, discomfort, injury, or limitations, and following any restrictions or recommendations provided by their healthcare professionals.
Additional informed consent, health screening, liability waiver, or other documentation may be required before participation in physical training services.
4. Nutrition Guidance
Nutrition services provided by Atlas Wellness are intended for general wellness, education, accountability, and behavior-change support.
Nutrition coaching is not medical nutrition therapy and is not intended to diagnose or treat disease, prescribe therapeutic diets, or replace care from a physician, registered dietitian, or other qualified healthcare professional.
Clients with medical conditions, specialized dietary needs, or concerns requiring clinical nutrition care should consult an appropriately qualified healthcare professional.
5. Membership Periods and Recurring Billing
Atlas Wellness memberships operate in four-week membership periods consisting of 28 days, rather than calendar months.
Recurring memberships require an authorized automatic payment method and renew every four weeks unless canceled in accordance with the applicable cancellation terms.
Specific payment amounts, billing dates, commitment terms, discounts, and payment authorizations may also be governed by a separate Membership Agreement and/or Automatic Payment Authorization completed by the client.
6. Payment and Failed Payments
Payment is due according to the schedule established when services are purchased.
If a recurring membership payment is unsuccessful, Atlas Wellness may provide a grace period for the client to correct the payment. If payment remains unresolved after the applicable grace period, services and future sessions may be suspended until the account is brought current.
Clients may also be responsible for bank, merchant, or payment-processing charges actually incurred by Atlas Wellness as a result of a failed or returned payment, where permitted.
Additional payment terms may be provided in the client's Membership Agreement or Automatic Payment Authorization.
7. Membership Cancellation
Recurring memberships may be canceled with 30 days' notice.
Cancellation requests should be submitted through the cancellation method designated by Atlas Wellness. Atlas Wellness may provide written confirmation identifying the effective cancellation date, final service date, and any remaining payment, credit, adjustment, or refund applicable to the account.
Cancellation of a membership does not automatically entitle the client to a refund for services already provided or for amounts otherwise earned under the applicable agreement.
8. Renewal Cancellation and Refund Requests
If a client unintentionally allows a recurring membership to renew, the client may contact Atlas Wellness within five calendar days of the renewal date to request cancellation of the newly renewed four-week period.
Where approved, any refund will be prorated based on unused services and may be reduced by services already provided, work already performed on the client's behalf, and nonrefundable payment-processing costs or other applicable charges.
Requests made after the five-day period generally will not result in a refund of the current membership period. The client may continue using services available during the paid period, subject to the applicable membership terms.
9. Commitment Discounts
Atlas Wellness may offer discounted pricing or other benefits in exchange for a client's voluntary commitment to a specified service term.
If a client ends a discounted commitment before completing the agreed term, Atlas Wellness may apply a Commitment Discount Adjustment reflecting discounts or benefits previously received based on completion of that commitment.
Any applicable calculation, authorization, final payment, exceptions, or other commitment-specific terms will be disclosed in the client's Membership Agreement or related authorization.
10. Scheduling, Rescheduling, and Cancellations
Clients should provide as much notice as possible when a scheduled session needs to be changed.
Atlas Wellness requests approximately three business days' notice for rescheduling whenever reasonably possible.
A minimum of 24 hours' notice is required to cancel or reschedule a session without forfeiting the session credit.
Cancellations made less than 24 hours before the scheduled session and no-shows may result in the session being treated as used and forfeited.
If Atlas Wellness must cancel or reschedule a session, the client will not forfeit that session because of the Atlas-initiated change.
11. Late Arrivals
Clients who arrive late may receive the remainder of their scheduled session.
For arrivals of up to 15 minutes, Atlas Wellness may extend the session to provide the full scheduled time when availability and scheduling permit.
Arrivals between 15 and 30 minutes late will receive the remainder of the originally scheduled session.
Clients who have not arrived within 30 minutes of the scheduled start time will be considered a no-show, and the session will be forfeited.
Atlas Wellness reserves the discretion to extend, reschedule, or otherwise accommodate sessions when extenuating circumstances warrant.
12. Unused Sessions and Rollovers
Membership sessions are intended to be used during the four-week membership period in which they are provided.
Unused membership sessions may roll over for one additional four-week membership period, subject to scheduling availability.
Any rolled-over sessions that remain unused at the end of that additional four-week period expire and are forfeited.
Atlas Wellness may, at its discretion, extend session expiration dates or make other reasonable accommodations in cases of illness, injury, military obligations, emergencies, or other extenuating circumstances.
13. Temporary Holds and Extended Absences
Atlas Wellness does not currently offer a standard membership hold or freeze program.
Clients anticipating vacations, travel, or other extended absences should plan their sessions within the applicable membership and rollover periods or cancel their recurring membership in accordance with the cancellation policy.
Unused sessions remain subject to the standard session expiration and rollover policy.
Atlas Wellness may make reasonable exceptions or accommodations for extenuating circumstances at its discretion.
14. Illness, Emergencies, and Extenuating Circumstances
Cancellations made less than 24 hours before a scheduled session remain subject to the standard late-cancellation policy and may result in forfeiture of the session.
Atlas Wellness understands that illness, emergencies, and other unforeseen circumstances may occur and may, at its discretion, make reasonable efforts to reschedule or otherwise accommodate an affected client.
Such accommodations are not guaranteed and do not establish an ongoing exception to Atlas Wellness policies.
15. Digital Services and Third-Party Platforms
Certain Atlas Wellness services may use third-party platforms, applications, scheduling systems, payment processors, communication tools, or other technology, including platforms used to deliver workouts or coaching support.
Use of third-party services may also be subject to the terms and privacy practices of those providers.
Atlas Wellness is not responsible for interruptions, outages, technical failures, or other circumstances outside its reasonable control.
16. Coaching Relationship and Client Responsibility
Successful coaching requires active participation by the client.
Atlas Wellness may provide education, guidance, accountability, perspective, recommendations, and tools, but clients remain responsible for their own choices, actions, participation, and implementation.
Atlas Wellness does not guarantee specific physical, financial, emotional, behavioral, relationship, or other outcomes from its services.
Results vary based on numerous factors, including participation, consistency, individual circumstances, and factors outside the control of Atlas Wellness.
17. Professional Boundaries
Wellness coaching and Atlas Insight Sessions may involve discussion of personal experiences, habits, beliefs, goals, behaviors, relationships, or patterns.
These conversations are coaching services and do not constitute psychotherapy, counseling, diagnosis, or mental health treatment.
If a client's needs appear to fall outside the appropriate scope of Atlas Wellness services, Atlas Wellness may recommend that the client seek assistance from an appropriately licensed or qualified professional and may decline or discontinue services when appropriate.
18. Respectful Conduct
Atlas Wellness is committed to providing a respectful and safe environment.
Harassment, threats, abusive behavior, discrimination, inappropriate conduct, or behavior that compromises the safety or wellbeing of the client, coach, or others may result in suspension or termination of services.
Atlas Wellness reserves the right to decline or discontinue a coaching relationship when maintaining the relationship is no longer appropriate, safe, productive, or within the scope of services offered.
19. Intellectual Property
Unless otherwise stated, website content, written materials, coaching resources, programs, educational materials, branding, graphics, and other original materials created by Atlas Wellness are owned by or licensed to Atlas Wellness AZ, LLC.
Materials provided to clients are for their personal use unless written permission is provided otherwise. They may not be reproduced, distributed, sold, published, or commercially used without authorization.
20. Privacy
Use of personal information is governed by the Atlas Wellness Privacy Policy.
Information shared during coaching may also be handled according to applicable client agreements and Atlas Wellness privacy practices.
Because Atlas Wellness coaching is not medical or mental health treatment, clients should not assume that communications are governed by healthcare-specific privacy laws unless those laws independently apply.
21. Website Information
Atlas Wellness makes reasonable efforts to keep website information accurate and current. However, information may change, and occasional errors or outdated information may occur.
Website content is provided for general informational purposes and should not be relied upon as individualized medical, mental health, legal, financial, or other professional advice.
22. Limitation of Liability
To the fullest extent permitted by applicable law, Atlas Wellness AZ, LLC and its owners, representatives, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or services.
Nothing in these Terms is intended to waive rights or responsibilities that cannot lawfully be waived.
Any additional assumption-of-risk or liability provisions applicable to physical training or other services may be contained in separate client agreements, waivers, or informed-consent documents.
23. Changes to These Terms
Atlas Wellness may update these Terms & Conditions as services, business practices, or legal requirements change.
The current version will be posted on this website with an updated effective date. Continued use of the website or services after changes become effective constitutes acceptance of the updated Terms to the extent permitted by law.
Material changes affecting an existing contractual membership may also be addressed according to the applicable client agreement.
24. Governing Law
These Terms & Conditions are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
